These Terms & Conditions govern your use of this website and, where you purchase goods or services from us, your contract with CUSTOMPACK. Read them alongside our Privacy Policy before you use the site or place an order.

We are not liable for indirect, consequential, or economic loss;
Our liability is limited to the value of the goods or services supplied.
Nothing in these Terms limits your rights under New Zealand consumer law.

10. Governing Law

These Terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.

GENERAL TERMS OF TRADE: CUSTOMPACK

These Terms apply to all goods and services supplied by CUSTOMPACK.

11. Definitions

Buyer / Customer: any person or entity purchasing goods or services from us.
Goods: all materials, products, equipment, or services supplied by CUSTOMPACK.

12. Orders & Acceptance

An order is an offer to purchase, not a confirmed sale.
A contract is formed once we confirm the order or deliver the goods, whichever happens first.
No variation to an order applies unless we agree to it in writing.

13. Pricing

Prices are in NZD and exclude GST, unless stated otherwise.
Prices may change without notice.
Delivery charges are additional.

14. Payment Terms

Payment is required on or before delivery.
Any debt recovery costs we incur are payable by the Customer.

15. Delivery & Risk

We deliver to the address the Customer provides.
Risk in the Goods passes to the Customer on delivery.
We are not liable for delays caused by circumstances beyond our reasonable control.

16. Retention of Title

Ownership of Goods remains with CUSTOMPACK until we receive full payment. Until then, we may repossess unpaid Goods in accordance with the Personal Property Securities Act 1999 (PPSA).

17. PPSA Security Interest

The Customer grants CUSTOMPACK a security interest in the Goods and their proceeds under the PPSA. The Customer agrees to assist with registration and, to the extent the law allows, waives the right to receive verification statements.

18. Returns & Defective Goods

Faulty Goods must be reported to us in writing within 14 days of delivery.
Returns require our prior approval.
Goods must be unused and in their original condition.

19. Consumer Guarantees Act 1993

Nothing in these Terms excludes your rights under the Consumer Guarantees Act 1993 where you’ve acquired Goods for personal, domestic, or household use.
Where Goods are purchased for business purposes, the Consumer Guarantees Act does not apply, to the extent the law permits.

20. Limitation of Business Liability

Where the Consumer Guarantees Act does not apply:
We may repair, replace, or refund defective Goods at our discretion;
Our liability is limited to the price paid for the Goods.

21. Default

If the Customer fails to pay, or breaches these Terms, CUSTOMPACK may:
Suspend supply;
Terminate the contract;
Recover any outstanding amounts immediately.

22. Amendments

CUSTOMPACK may amend these Terms at any time. Updated Terms apply to all future transactions from the date they’re published.
